【摘要】 随着农村社区和农村经济的不断发展,农民能动性越来越强,农民自觉组织起来快速获得市场信息、降低交易费用、应对市场风险。农民合作经济组织也快速成长起来,在其发展过程中面临着组织发展不规范、组织程度不高、保障机制不健全等一系列的问题。如何完善当前的农民合作经济组织的法律制度,为合作组织提供全方位的服务,已经成为农民合作经济组织亟待解决的问题。基于此,针对我国农民合作经济组织发展的现状及存在的问题,有必要对农民合作经济组织的法律和保障机制进行研究。目前,国内从农村社区视角进行专门分析比较少见。而本研究正是基于农村社区发展展开的农民合作经济组织发展的法律制度和保障机制问题研究。国内外对于农民合作经济组织发展都有成功的例子可供借鉴,无论是美国、德国、法国的成功经验,还是国内陕西、山东的发展模式都可以给我国农民合作经济组织的发展提供有利指导。这其中也存在结合农村社区发展的经验总结。农村社区与农民合作经济之间相互联系,彼此促进。农民合作经济组织是农村社区形成与发展的助推力,而农村社区则是农民合作经济组织发展的有利平台。农村社区的发展对于农民组织化程度的提高,农村内部市场的培育,政府农村政策的实现,以及农村服务的改善都具有积极的作用。然后,结合农民合作经济组织发展的现实需要,从农民合作经济组织发展的法理念出发,探索农民合作经济组织的价值追求；基于合作组织合作原则二元价值协调的考虑,强调将农民合作经济组织的经济价值与伦理价值协调发展,既注重农民合作经济组织的经济发展的需要,又不能背离农民合作经济组织的内在要求；从资本制度、产权制度、组织制度、分配制度和责任制度等方面完善我国农民合作经济组织的法律制度。本文创新性地以农村社区为视角进行农民合作经济组织发展的体系化研究,完善农民合作经济组织的法律制度,同时从农村社区角度构建农民合作经济组织发展的保障体系,建立起包括农村社区在内的农民合作经济组织多元主体保障体系；有利于农民合作经济组织发展的外部环境体系,完善农民合作经济组织的内部治理结构,以及提出有利于农民合作经济组织发展的农村社区发展的具体对策。

　　【Abstract】 With the rapid development of rural community and economy, farmers’dynamic nature is becoming stronger and stronger,they help themselves to organize to acquire market information rapidly and reduce the transaction cost in order to resist the market risks.it also urges a lot of Farmers’Cooperative Economic Organizations (FCEOs) to grow rapidly,but on the progress of its rapid growth,there are aseries of problems such as the nonstandard development,weak cooperation and distempered growth mechanism.and so on.How to establish the low operating cost and efficient organizational mechanism in order to provide a full range of services for farmers has become the problem that FCEOs need to solve urgently.Based on the background,the current status and existing problems of the FCEO,it is necessary to study the growth mechanism of FCEOs.At present, the domestic rural community perspective from specific analysis relatively is rare. And this research was the development of the legal system and the safeguard mechanism study the problem based on rural community development on farmer cooperative economy organization. Domestic and foreign to the farmer cooperative economy organization development are examples of success for reference, such as the United States, Germany, France, or the successful experience of domestic shanxi,shangdong development model can provide favorable guidance for the farmer’s economic cooperation organizations. There is also with the rural community development experience. Rural community and the farmer cooperative economy promote each other. The farmer cooperative economy organization is the formation and development of rural communities and rural community is the favorable platform for the farmer cooperative economy organization. The development of rural communities can improve the degree of the farmers, cultivate internal market, implement rural policy of government, and improve the rural service.
