【摘要】 本文结合建设社会主义新农村的现实与理论背景，提出农民合作经济组织社会责任理论这一崭新论题。在社会主义新农村建设中，农民合作经济组织是农户进入市场的重要组织载体。其本身是独立的市场主体，同时还承载着为农民和农村社区服务的特殊使命。即农民合作经济组织不仅是农村经济与社会可持续发展的重要主体力量，而且也承载着保护农民利益和促进和谐社会构建的重要社会责任。农民合作经济组织社会责任理论的提出与构建是社会主义新农村建设以及和谐社会建设的重要课题之一。首先，从农民合作经济组织的国内外发展历史的探寻入手，运用历史的比较分析法，从中找出其承担社会责任的历史底蕴。并进一步分析农民合作经济组织的基本理论，包括其基本概念范畴、基本法律属性和基本法律原则，对我国现有的合作经济组织相关法律规范作了简要分析。其次，从农民合作经济组织市场主体地位的确立为切入点，运用理论分析、法理分析的方法，初步架构农民合作经济组织社会责任的基本理论。指出农民合作经济组织的社会责任，即在寻求实现自身发展的基本目标的同时，维护所有利益相关者的利益的义务。并提出农民合作经济组织社会责任理论所蕴含的法理学价值是公平与正义价值、社会整体利益价值、可持续发展价值。再次，结合我国农民合作经济组织发展的实际，运用经济分析、公共政策分析和法律实证分析等方法，对我国农民合作经济组织社会责任进行具体内容的归结。初步确定从对投资者和债权人的社会责任、对职工的社会责任、对消费者的社会责任、对政府的社会责任和对社区的社会责任这五个方面展开。其中，对社区的社会责任又包括对社区环境保护的社会责任、对社区福利及公益事业的社会责任、对社区文化建设事业的社会责任这三个方面。最后，将农民合作经济组织社会责任的实现与社会主义新农村建设理论相结合，提出建立农民合作经济组织、政府及农民个人的三方互促关系。并在以上研究基础上，对我国农民合作经济组织社会责任的法律实现提出初步的构想和制度设计。主张以适度超前原则为指导性原则，建立农民合作经济组织法律责任制度，并运用经济法调整方法，即强行性规范与任意性规范相结合，否定式法律后果与肯定式法律后果相结合的方法，设立农民合作经济组织社会责任的原则性规定。在具体规则的设置上，主张整合现有法律资源，建立职工参与农民合作经济组织机关的制度，并进一步完善农民合作经济组织内部治理结构。
