吴琪:农地股份合作社运行机制规范与实证研究

  【摘要】农村合作经济组织起源于 20 世纪 80 年代,我国农村确立了以家庭承包经营为基础、统分结合的双层经营体制,农民不仅获得了生产经营自主权,而且成为了独立的财产主体和市场主体。但是随着经济的发展,合作社开始表现出不适合发展的弊端,比如融资能力较差等。面对这一现状,我国开始出现了合作社公司化的倾向,即农地股份合作社。但是合作社的公司化倾向,农地股份合作社又可能违背合作社为农民服务的宗旨,进而改变合作社的性质。所以本文选择基于合作社与公司制企业的比较研究的视角,来探索农地股份合作社如何在保持农民专业合作社性质的基础上,最大限度的吸收公司制企业的优势,以便从制度设计与制度实施上解决合作社公司化所面临的问题。为我国企业更好的完善的发展提供理论依据,同时为合作社探索出一条适合我国国情的突破当前现状的发展道路。

  目前,我国的农地股份合作社还处在初级发展阶段,还没有完善的法律体系予以完善。虽然有很多的进步意义,但是不可避免的存在很多问题。本文在对农地股份合作社与公司制企业比较的视角下,对我国的农地股份合作社的运行机制进行规范性分析,以为农地股份合作社的理论研究奠定基础。

  江苏省率先在全国将农地股份合作社纳入法律的范围,首次对农地股份合作社予以肯定,该区农地股份合作社的运行机制值得研究。本文选取江苏省常州市武进区进行实地调研,采用面对面的访谈方式获取数据和信息。对内股外租型这一不进行实体经营的农地股份合作社进行深入调研,来探讨新型的农地股份合作社是不是一定要进行实体经营。这一不进行实体经营的农地股份合作社是不是符合我国某些地区的经济发展,是不是保持了合作社的性质并能够很好的满足农民的需求。

  最后得出以下结论,内股外租型农地股份合作社基本符合农地股份合作社的性质,但是也存在很多的问题。该种不进行实体经营的农地股份合作社能够很好的适合在某些经济发达地区的发展,但不适合在全国进行推广。

  【Abstract】Rural cooperative economic organization originated in the nineteen eighties, China's rural areas were to establish the integrated combined with separated two-tier management system,based on the household contract. Farmers not only obtained the production and operation autonomy and became the independent main body of property and market. But with the development of economy, cooperatives began to show defects that were not suitable for the development, such as poor financing ability and so on. Faced with this situation, cooperative economic organizations began to appear a tendency of corporate enterprises, namely the shares of agricultural land cooperatives. But the company tendency of cooperatives may violate the purpose of cooperatives that serve for the farmers, and thus change the nature of the cooperatives. Therefore, based on the comparative study perspective of the cooperatives and the companies, this paper want to explore the shares of agricultural land cooperatives how to maintain the nature of the cooperatives and maximum the absorption of the advantages of the corporate enterprises, in order to solve the problem faced by the cooperative company from the design and implementation of system. For one hand, we can explore a proper way for the national conditions of our country to break through the current situation; for another hand, can provide a theoretical basis for the better development of enterprises.

  At present, China's agricultural land share of cooperatives are in the initial stage of development and the legal system is not very perfect. Although there are a lot of progressive significance, inevitably there also exist many problems. Based on the comparative perspectives, the paper analyses the operating mechanism of the shares of China's agricultural land by the normative method, in order to lay the foundation for the theory of the shares of agricultural land cooperatives.

  Jiang Su province was the first one in the country that includes the shares of agricultural land cooperatives into the legal scope, and the operating mechanism in this area is worth studying. This article selects Wu Jin District of Chang Zhou city to conduct field research, using face-to-face interviews to obtain data and information. The paper selects the kind of internal shares for rent cooperatives, which do not have entity operates , to be carried out in depth, and to explore whether the entity operates are necessary for the cooperatives. The paper will find out whether the new kind cooperatives are in line with the economic development of some areas and are able to meet the needs of farmers.

  Finally, we can draw the conclusion that the shares of the rent of agricultural land cooperatives are in line with the cooperative nature of the shares of agricultural land, but exsiting a lot of problems. The internal shares for rent cooperatives, which do not have entityoperates , can be very good for the development in some economically developed regions, but not suitable for the promotion in the whole country.
