【摘要】本文通过比较研究、实证研究、历史研究等研究方法首先对与农民专业合作社成员权利有关的基本理论问题进行了研究，包括对合作社概念、性质、特征的研究、对农民专业合作社定位、概念、特征的研究、对与农民专业合作社成员有关的一些基本问题的研究等；其次，本文对农民专业合作社成员权利的概念、性质和意义进行了讨论和分析；第三，本文以我国的《农民专业合作社法》为基础并结合大量国内外理论和立法，对农民专业合作社成员权利的框架进行了充分的研究，包括“农民专业合作社成员权利框架的各国立法模式分析、我国农民专业合作社成员权利框架、我国农民专业合作社成员权利框架的不足及完善”三部分内容；第四，本文又对我国农民专业合作社成员权利中每一项具体成员权的内容、特征、行使方式、行使条件、行使程序等问题进行了详细的分析和论述，并提出了自己的看法和建议；同时还对北京近郊的某农民专业合作社进行了实地调研，并以此为基础对农民专业合作社成员在行使权利过程中遇到的一些现实问题进行了实证分析和研究，并提出了自己的观点和意见。

　　【Abstract】Through the comparative study, empirical research and historical research, this paper studies the basic theoretical issues of agriculture cooperative first，including the research on the concept, nature and character of cooperative; the research on the positioning, concept and feature of agriculture cooperative; the research on some related issues of agriculture cooperative members. Secondly, this paper discusses the concept, nature and significance of the right of agriculture cooperative members. Third, this paper analyzes the frame of the right of the agriculture cooperative members on the basis of "China Agriculture Cooperative Act” and a large number of domestic and international theory and legislation. This chapter includes three parts: “the analysis of national legislative pattern of the frame of the right of agriculture cooperative members, the research of the frame of the right of the chinese agriculture cooperative members, the shortage and perfection of the frame of the right of the chinese agriculture cooperative members”. Fourth, this paper analyzes and discusses the specific content, feature, the manner of exercise, the exercise condition, the exercise procedure of each member’s right and put forward my views and recommendations. Finally, this paper analyzes the problem in practice after the writer went to a agriculture cooperative in the suburb of Beijing for research.
